\n\t1.DEFINITION AND OBJECT OF THE CONTRACT<\/span><\/strong><\/p>\n

\n\tThis contract (“Contract”) is a distance contract within the meaning of Art. 50 et seq. Of D. Lgs. September 6, 2005, no. 206 (“Consumer Code”). The Contract is for the sale of movable goods between Amore Raffaele snc di Amore Michele e C. with registered office in Rovereto, via Parteli, 29 – C.F. and P.IVA 01788790226 and the consumer (the “Customer”).<\/span><\/p>\n

\n\tThe Contract is concluded directly through the acceptance by <\/span>Amore Raffaele snc<\/span> of a purchase proposal issued by the Customer by telephone or through the Internet on the website www.dittaamore.it (the “Site”) on the basis of the manner described in Article 4 below. Any amendments and\/or additions to the General Terms and Conditions will be effective as of the date they are announced to the public and will apply to sales made on or after that date.<\/span><\/p>\n

\n\tThe latest updated version of the General Terms and Conditions can be found on the Site.<\/span><\/p>\n

\n\t2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND COMMITMENTS OF THE CUSTOMER<\/span><\/strong><\/p>\n

\n\tThe Customer, by electronically sending the confirmation of its purchase order, unconditionally accepts and undertakes to observe in its dealings with <\/span>the company Amore Raffaele snc<\/span>, the general and payment terms and conditions transcribed below, stating that he has read and accepted all the directions given to him under the above regulations, noting also that <\/span>the company Amore Raffaele snc<\/span> itself is not considered to be bound to even partially different conditions unless agreed in advance in writing.<\/span><\/p>\n

\n\tThese Terms and Conditions must be reviewed online by Customer visitors to www.dittaamore.it before they confirm their purchases.<\/span><\/p>\n

\n\tThe submission of the order confirmation therefore implies full knowledge of the General Conditions of Sale and their full acceptance.<\/span><\/p>\n

\n\tThe Customer undertakes and is obliged, once the online purchase procedure is completed, to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully comply with the conditions of D. Lgs. September 6, 2005, no. 206 (“Consumer Code”).<\/span><\/p>\n

\n\t3. PRICES<\/span><\/strong><\/p>\n

\n\tThe sale prices on the Site and\/or through any other distance selling systems of the<\/span> company Amore Raffaele snc<\/span> Are VAT included. Freight charges are shown before the purchase confirmation transparently and inversely proportional to what you buy (The more you buy, the less you spend on freight). Free port for shipments over \u20ac150.00 + vat excluding Calabria, Sicily, Sardinia and smaller islands where it is necessary to reach \u20ac300.00 + vat for free port. They are always charged for shipments of some types of flours, sugar, biolit, and ‘earthworm humus given their high weight and low cost. This is well highlighted in the subject articles. Overseas shipping is always charged.<\/span><\/p>\n

\n\t4. MODE OF PURCHASE AND PAYMENT<\/span><\/strong><\/p>\n

\n\twww.dittaamore.it is a Web site that offers the opportunity to purchase disposable, biodegradable and compostable, recyclable, and human food products. All specifically identified through appropriate tab on the Site.<\/span><\/p>\n

\n\tPurchases of the products, available as illustrated and described online in the relevant descriptive and technical sheets, is made by the customer at the price indicated therein, to be confirmed at the time of submission of the order confirmation, in addition to transportation costs as specified on the site and in any case displayed at the time of purchase.<\/span><\/p>\n

\n\tPrior to confirmation of the purchase to the Customer will be summarized the unit cost of each product chosen, the total cost in case of purchase of more than one product, and the relevant transportation costs, if less than free port.<\/span><\/p>\n

\n\tTo place an order, it is necessary to register and fill out the form that the customer will find in the section of his or her orders following the instructions that will be indicated during execution.<\/span><\/p>\n

\n\tThe order consists of the summary page, which is accessed after pressing the “Confirm Order” button, which you should print and keep.<\/span><\/p>\n

\n\tThe language in which it will be possible to make a purchase is Italian. The purchase proposal sent through the site, represents the order of material and is intended to be confirmed.<\/span><\/p>\n

\n\t5. DELIVERY OF PRODUCTS<\/span><\/strong><\/p>\n

\n\t6. PRODUCT AVAILABILITY<\/span><\/strong><\/p>\n

\n\tThe company Amore Raffaele snc<\/span> accepts Customer orders within the limits of the quantities of the required products existing in stock (On the site you can see the availability of goods at the time of ordering).<\/span><\/p>\n

\n\tThe company Amore Raffaele snc<\/span> undertakes to promptly notify the Customer of any unpredictable out of stock and the timing of restocking.<\/span><\/p>\n

\n\t7. WEIGHT AND QUANTITY OF PRODUCTS<\/strong><\/p>\n

\n\tThe weight, size, and quantity of the products in the original manufacturer’s\/supplier’s packaging is determined mechanically with a possible variation of +\/- 5% from the stated standard.<\/span><\/span><\/p>\n

\n\t8. WARRANTIES, SERVICE AND COMPLAINTS<\/span><\/strong><\/span><\/p>\n

\n\tAny non-conformity of the products must be reported, in writing, as soon as the non-conformity is found.<\/span><\/span><\/p>\n

\n\tThe written report must be attached by the customer when returning the defective product.<\/span><\/span><\/p>\n

\n\t9. OBLIGATIONS OF THE CUSTOMER<\/strong><\/span><\/span><\/p>\n

\n\tThe Customer represents and warrants under its sole and exclusive responsibility: (i) to be a consumer as defined in Art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by it for the performance of the Contract are correct and true.<\/span><\/span><\/p>\n

\n\t10. ORDER CANCELLATION<\/strong><\/span><\/span><\/span><\/p>\n

\n\tIt is possible to cancel your order for any reason before the procedures for shipping the ordered products have begun.<\/span> <\/span><\/span><\/p>\n

\n 11. RIGHT OF WITHDRAWAL <\/span>

\n\tThe Customer has the right to withdraw from the contract entered into, without penalty and without specifying the reason, within 10 (ten) days of receipt of the products.<\/span><\/span><\/p>\n

\n\tThe Customer may exercise the right of withdrawal, within the aforementioned period, by written notice at the head office of the company Amore Raffaele snc, to be sent by registered letter with acknowledgment of receipt or by telegram, certified electronic mail (dittaamore@pec.it) or telefax (0464-423295) provided it is confirmed by registered letter with acknowledgment of receipt within the next forty-eight hours.<\/span><\/span><\/p>\n

\n\tRegistered mail is considered to have been sent on time if it is delivered to the accepting post office by the deadline.<\/span><\/span><\/p>\n

\n\tThe Customer who intends to make use of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 10 days from receipt of the products.<\/span><\/span><\/p>\n

\n\tPursuant to Article 55, second paragraph, of the Consumer Code, the Customer shall not have the right of withdrawal in the following cases:<\/span><\/span><\/p>\n

\n\t– Provision of “tailor-made” and\/or customized products or products that by their very nature cannot be returned.<\/span><\/span><\/p>\n

\n\t
\n – F<\/span>
\n<\/span>orniture of food delivered with regular expiration date.<\/p>\n

\n\tThe cost of returning products is the responsibility of the Customer. The company Amore Raffaele snc will return, within 15 days from the date of receipt of the products by the Customer: (1.) the full price paid by the Customer, if the product is returned complete with all its parts, or (2.) the part of the price equivalent to the product actually returned by the Customer. In any case, will be retained the portion of the price relating to shipping charges.<\/span><\/span><\/p>\n

\n\t12. JURISDICTION<\/strong><\/span><\/span><\/p>\n

\n\tThe Contract is governed by Italian law.<\/span><\/span><\/p>\n

\n\tAny dispute relating to the application, execution, interpretation and breach of the Contract shall be within the jurisdiction of the Court where the Customer has its residence or domicile, if located in the territory of the Italian State, or within the exclusive jurisdiction of the Court of Rovereto (TN), if the Customer has its residence or domicile abroad.<\/span><\/span><\/p>\n
